Individual taxpayers in India can choose between two regimes. The new regime offers lower slab rates but removes most deductions and exemptions. The old regime keeps higher rates but lets you claim deductions such as investments, insurance premiums, home loan interest and HRA. Neither is better for everyone. The right choice depends on your numbers.

The new regime is the default

Unless you opt for the old regime when filing, your return is processed under the new regime. Salaried employees are usually asked to declare their choice to their employer at the start of the year so TDS is deducted correctly, and in most cases can still make the final choice when filing the return.

A practical way to compare

  1. List your actual deductions. Include only what you genuinely invest or pay, not what you might.
  2. Compute tax under both regimes. Use the current year's slabs, rebate and standard deduction.
  3. Compare the totals. The regime with the lower final tax is usually the right choice for that year.

When the old regime often wins

  • You pay significant home loan interest
  • You claim HRA on rented accommodation
  • You already make full use of tax-saving investments

When the new regime often wins

  • You have few deductions or investments
  • You prefer flexibility over locking money into tax-saving instruments

Points to keep in mind

  • Slabs and limits can change in each Union Budget, so recheck the comparison every year.
  • Individuals with business income have more restrictions on switching between regimes.
  • Don't invest only to save tax. The investment should make sense on its own.
